Dollar General Case Dismissed

On Tuesday, the Georgia Court of Appeals dismissed the case filed by Terramore LLC against Glynn County and the Island Planning Commission. Terramore was challenging the IPC’s denial of their site plan for a proposed Dollar General store on St. Simons. Glynn Superior Court Judge Steven Kelley ruled in favor of the county in January of 2017, after which Terramore filed the suit in Appeals Court. While the Appeals Court inititally accepted the case, in March of 2017 the Georgia Supreme Court ruled in an unrelated case that certain procedures must be followed in these types of cases before they can be heard by a local Superior court. Citing that case, the Court of Appeals vacated their prior order and dismissed Terramore’s case.
